Out of state tint requirement

Hey guys,
I have a 300c with tinted windows. My car is registered in Georgia with Georgia Plates. I will be in and out of Hawthorne, NY for a few months. Does anyone know if the NY tint law applies to out of staters?

Officer Friendly was kind enough to give me a free ticket for "Illegal Tint, Must Remove" in California a while back. When I explained that I live in AZ and the Car is registered in AZ he replied: "Doesn't matter, you are driving it in California". He also gave me a free ticket for 98 in a 65.

Boy he sure was generous!

That officer was correct. Legally you need to follow the laws of the state you are driving in.

I hate to disagree, If your state does not allow a front plate and you travel into a state that does you will not get a ticket. Same goes with tint. BXTPR could answer this question. I know he knows! LOL
Only if both states comply with one another will you recieve a ticket. I'm 90% sure NY does not comply with any states EXCEPT Canada!

This is different. I know multiple people who have come in to the state, usually from Jersey or CT, gotten tint tickets, gone to court, only to be told that they have to comply with our laws.

I don't beleive that this is constitutional. The "Dormant Commerce Clause" doctrine prohibits states from passing regulations that unreasonably restrict interstate commerce. Interstate commerce is exclusively the province of the federal government. There is a difference between operation laws and equipment laws. For instance, California can't require that cargo trailers be exactly 30' long, when the standard is 29'. But California can say that trucks can only drive in the middle lane.

BTW, the civil rights laws were first upheld on the basis that "white only" hotels unreasonably restricted the travel of blacks, and thus violated the dormant commerce clause.

But I searched and could not find a case where the issue was presented to a court in those terms. And the likelihood that some municipal court judge will hold the law unconstitutional is pretty damn slim anyway. "Dormant what? Son, are you on drugs?"

Sounds plausible but Im sure you are right....no municipal judge is gonna go for that one.

I know here in VA they can write you a ticket for tint even if you are out of state. As far as I know its a payable fine for a first offense (no removal). I think its a judgment call. If you get pulled doing 20+ and you have a tinted windshield then expect a tint ticket. If your just passing through town and your front side windows are a little darker than the next guy you likely wont get noticed.

Good luck on the trip....watch out for the snow!

Funny you should say that. When I entered VA from NC, right at mile 1, 3 troopers pulled me over. He said "I pulled you over because your front window was dark." I told him that I am heading to NY and just passing thru. He said GA requires 35% in the front and you are at 20%. He cut me a ticket. I did not have any problem in Delaware and MD. The evening darkness and snow helped stealth my car but even then I saw plenty of people driving on I95 with 20% and less all round. I know NJ has no tint in the front, I hope I dont get screwed here since I crashed for the night at Warren.

As long as your vehicle is still legally registered in Georgia, or whatever state you are from, then technically you can drive with your tinted windows with no legal recourse. I'm not saying that you won't receive a summons for it, most likely you will not for that offense alone, but, like the above poster stated "if you are traveling 20+ mph over the speed limit" you can expect what ever citations the officer writes you. Bottom line, don't sweat the tints in NY as long as you aren't drawing attention to yourself for multiple reasons. hope this helps. FYI, this is for NEW YORK, good luck in others.

Thats BS. You don't necessarily need to be doing anything else to be pulled over for tint. I was pulled over twice with my BMW for just tint, once in Nassau, once in Queens.
