Angry Dealer flat out lied!

Can't believe I didn't see this one coming but I got took for HID upgrades at the dealership.

My wife and I went into our local Chrysler dealer in Beaverton Or to buy a brand new 300C. The dealer was offering $1000 cash back but you had to take delivery from dealer stock. No problem, they had what I wanted except no HIDs. Durring the "negotiation" we: the salesman, sales manager, my wife and I agreed that we would take the deal they offered if the headlights were upgraded to HIDs. "Okay. We will order the parts and let you know when they come in". Yesterday my baby is in to be detailed at the dealer and have the HIDs installed when I get a phone call "We cant make these bulbs work". Why not? I asked the sales manager that very question and his response was that it was his recolection that he agreed to HID bulbs only and the paperwork that my wife and I signed accepting thier offer (which details the terms of sale including "bulbs and power packs") seems to have gone missing.

I could find a lawyer to represent me (mabey) but since we were not given a copy of the agreement it would be our word against thiers. This was my first new car purchase and I have learned some valuable lessons. It's just unfortunate you can't take anyone at thier word anymore.

NEVER sign any contract that you do not get to keep a copy of. ALWAYS write down EVERY detail of your deal on that contract.

The question to ask is do you want to buy a car from this guy? Do you want to deal with him in the future? If he can't show you the paperwork with the HID amendments and your signature on it, then I guess he has no paperwork binding you to buying that car.

Unless he is losing money on this deal, making some money is better than none. Go there and say give me the lights or I am walking. Your wallet will speak louder right now than a lawyers letter will two weeks from now.

Have you taken physical delivery of the car? If so, and you still want to fight, you can simply inform them that you will sue them and that document WILL be discovered through a subpoena. There are also verbal agreements that can be upheld in the some States. I think you can prove it pretty easy in the fact that they will also show paperwork that they 'tried' to hook up the lights and were unable to. That, in itself, shows there was some type of deal.

If you have not taken physical delivery of the vehicle...say goodbye to them and start over somewhere else.

Good luck and sorry to hear about that. I hope you find the right deal and get taken care of.

Moose.

Sorry to read of your shafting by a dealership in BEAVERton. Quite obviously they’ve got their head up their beavers on this deal. Does your local media offer any kind of consumer investigation type teams? I know down here one of the local channels has one of those teams who go after consumer fraud and put them on TV. Just last week there was a story of one of the used car dealerships charging something like 32% interest on short term loans for a 10 year old car……. just an idea to cast light on the sneaky thieves. Send them a link to this thread. We’ll all be glad to post how we’re going to boycott those thieves in BEAVERton. (You just gotta love the name!) Sorry, I'm really only 12 yrs. old

Wow, that speaks of outright theft and lies. Do you remember the sales "manager"? In my experience the Real managers never go in the office and get mired down on a specific deal, they have to remain in their offices and oversee all salesmen and their deals. Only the Closers, or to take the evil sting out of the word, the "assistant managers", ever come face to face with the buyer during the negotiations phase.

Anyway, the sales manager saying they agreed to the "bulbs only" is ludicrous and insulting. He of all people should know his product and that it needs a ballast and igniter (one for each bulb, in fact) plus the associated wiring harnesses, etc., to make real HID xenon bulbs "work".

If you could let people know the name of this particular dealership we could post up on the net everywhere about your experience. In fact that might even help to jog the dealer's "memory" about this HID promise they made you...:rolleye:

I take it that this wasn't written on the actual bill of sale contract then?

At this dealership the initial negotiation is a hand written document which is then "approved" by a "General Manager" in an office in the back. This hand written document is then typed up and both parties sign it. This is the official offer you are agreeing to. We did not get a copy of this typed document (like I said it was my first time buying a new car) so shame on us. This is the document which spells out in line-by-line detail what is included in the sale and this is the document that has gone "missing".

If you haven't picked up the car, then they have no written contract saying you have to buy the car. When you tell them you are walking away, this agreement will mystically appear and you will get your HID.
