Do I have a complaint?

Last Summer I recent Bought a 05 Chrysler 300 Touring. It was advertised as a Touring, and has touring on the Ownership. I bought it at a different dealership that I get it serviced at. and they told me that Its just a base model. and showed me the difference btw Base and touring. The other place didnt, so I called them, and left a message with my claim.they dont call back. So I sent an email to Chrysler, and I never got a reply from them either.
I did put 20,000 kms on this car. But I didnt find out till recently.

What do I do?
Shall I get a lawyer? I dont know if Id have a case or not.

I would think you could make them take the car back. If the vehicle was sold to you as a Touring and it is not, then you did not get what you paid for. It is very important for you to check the paperwork for htis detail. At a minimum the dealer owes you money back since the Bluebook on a Touring is higher than on a base model. It might be necessary to use a lawyer to get this resolved though.

I would talk to a lawyer in your area. There are some tricky loopholes that dealers try to bring up when there is a problem.....TYPICALLY, the rule of thumb is, if its one the invoice, you better have it on the car! The dealers will always try to say that the features were added or deleted at the dealership and therefore the sticker "may" be inaccurate.

Talk to someone who can help, trust me, I'm a lawyer

You say that you have had the car since last summer? So, you have had
it almost a year, and its going to be very hard to do something about it since
you have owned and driven the car all this time.

Did you get the window sticker with the car when you bought it? Check
the items that are on the window sticker or your sales papers, with the cars
VIN number to verify that the car you recieved is the car that is listed on the
window sticker/sales papers.

Other than that, just because the salesman at the dealership called it a
"Touring" model, its YOUR responsibility to make sure that it had all the proper
"Touring" items on it, and that it was indeed a "Touring" version.

I have been to many dealerships, and almost ever salesman calls every 300
model a "300C". Now, we know that the "300C" is only the one with a Hemi,
but all those salesmen call every car a "300C". But its up to the buyer to
make sure you are buying a "300C" and not just a regular "300".

Now, if this dealership put "Touring" badges on a base model 300, and then
said it was a real "Touring" version, then that is illegal, and you do have some
recourse against them, as this is blantant missrepresentation, and they can
be sued for this.

What is the difference between the 300 touring and the base besides the engine and fog lights. I have a 300 touring and it has a "300" emblem on the back and not a "300 touring" Most people that see my car think it it a base but, when I look up the vin it's a 300 touring. I have the 3.5l , fog lights, sunroof and powers seat, but I have cloth interior.

If your paperwork (bill of sale) says Touring and they delivered a different car then you may have a case. You drove it nearly a year without knowing, a judge may ask how does this happen, you obviously did not miss the Touring features as you discovered this by chance, actually someone else discovered it.

What is listed on the window sticker ? You did save it in a folder with all your other records?
Is the price you paid for a Touring (above your Base window sticker price) or at/below the base model price. This is where any fraud on the dealership's part will show up, charging for a Touring and delivering a Base.

For the US spec'd models, I don't believe that cloth seats were even a '300 Touring' option when I did my initial research.

I do know that the gearshift selector knob is different, as I have one of each as spares...the '300 Touring' one which came off my car has bright chrome trim and is padded and leather-wrapped. The '300 base' one I have has a brushed satin trim and is made of hard black plastic (Urethane - made to look like leather). The 'Touring' steering wheel is also leather-wrapped and I believe that the steering wheel utilized on the 'Base' model is again Urethane.

In 2005, the 17" OEM '300 Touring' wheels were silver painted six-spoke aluminum wheels with center caps that hid the lug nuts...ala '300C' style, but for 2006, the 17" OEM '300 Touring' wheels were improved/redesigned (look much better), are not painted, and come with smaller center caps which leave the wheels nuts exposed...ala 'SRT-8' style. The '300 Base' model came OEM with 17" black steel wheels with silver painted plastic wheel covers (hub caps). Both the 'Touring' and 'Base' models came OEM with P215/65R17 Goodyear 'Integrity' tires.

More than just fog lights and upgraded mirrors, the 'Touring' also came with ESP, ABS, and All-Speed Traction Control, and Emergency Brake Assist as standard equipment. I hope this info helps.

KNOW what you buy before you buy and look at it to see of it meets to your satisfaction then sign on the bottom line because it is a binding contract.
