Thumbs down 4 trys still not fixed lemon law?

well i posted a month or so ago about break grinding in rear end.ive taken my C back to the dealership 4 times for the same thing.the first three times the just adjusted the e brake assembly and did whatever. but still drove away with same problem.now the 4th time i brought her back i was met by the area rep. took a drive with him he heard same noise and said no problem will just replace rotors and pads and the ebrake kit and it will be fine no more grinding...well a week later i get a call from the shop "come get your car its ready"i said so hows it now?they said its even worse then before .to top it all off the area rep hasn't even called me yet?but i have this friend that works for dc and he got the area reps.bosses phone# and i called him today he returned my call and we went threw the same thing i just explained.long story short i told him that i was not going to let them touch my car again and that lets make a deal so i dont have to go threw the lemon law.i said my deal was i trade my C for the new srt and i would pay the difference in cash and that we could make a deal on the mileage.he said he had to get all the facts and he would get back with me.but i could tell he didn't like the idea.but if he doesn't then at all costs i will fight this and get the lemon law!has anybody done the lemon law?what chances do i have on the trade?

The legal term for getting a replacement car is called "Substitution of collateral". Swapping one car for another. Mention this term to the dealer and see if it rings any bells. IMO, you are complicating the issue by throwing the SRT-8 into the equation. Getting an SRT-8 may be tough enough, let alone from a dealer that is grudgingly replacing a defective car. You are just giving the dealer more ways to jerk you around.

Shame to hear about the problems with your 300C. But I totally agree with joey on this one. If the law in your state does have a lemon law which states that they'll replace the car with the exact same one you have then just take a new 300C. If you really want a SRT you can always flip a brand new 300C after you get it replaced with the one that is giving you trouble. I wouldn't really try to make deals with the dealer nor DC because honestly I think the last thing they want to do at this point is replace your car and I would stick with what the lemom law states and just try to get your 300C replaced and worry about the SRT after. Keep us updated.

thanx for your thoughts guys.ill take your advice on just getting her swaped out for the same and then fliping over to the srt.but i know iam gonna have a hell of a hard time getting a brilliant black again because they still have a shortage of that color.but will see what happens.ill kep everybody updated.

i know ur in 321 i hope u didnt get it from gator casue they def. arent getting a srt, they only got a couple c's and wery limited in options. i pulled up in the c one time to get a tire fixed and they labeld it a 300m

Lemon law remedies vary state to state.

I live in Kalifornia, and have done some lemon law work. Even here, in the consumer paradise, no way you could legally force an upgrade, even if you 1) have a lemon, and 2) pay the difference.

Check with a local consumer rights attorney, make sure you have all the information before you even try to cut a deal.

First off, you need to know the requirements to define a "lemon" in your jurisdiction, then you need to know what your remedies are.

Only then should you consider making deals to resolve this.

well i was contacted by the area rep.he said that he spent a halfa day on the phone about my car.he also said that they wanted to work on my car one more time. i said NO, i told you that after the forth time that was it..so after a few min of him babiling he said ok iam going to get the paper work going and that i had 2 choices...1 they just take car back and give me my money back..2 that he would order a new one and that i wouldnt get charged for any extra miles.so i dont think the srt is gonna work out but iam going to take a new one and who knows maby ill juss flip it over for the srt if 1 is aval.but i havent seen any paper work yet so iam not going to get to happy.

Sounds promising... I suggest you ask them to fax or scan a copy of the paperwork they have done so far so that you can decide whether or not you will need an attorney to protect your interest. Also ask him to give you an approximate timeline in writing. Good luck!

Sounds like things are working out and also people here have given you some good advise. You seem to have done better than me. FYI and help my story from New Jersey:

- My car was back like 6 times for the same problem. Lurching on cold start up. Problem was it was intermittent.
- Escalated to the regional rep like you did and played hard ball with them. Requested another car. Problem was when he came the car did not act up. The service manager has definitely seen the problem and knew I had big issues but when the rep was there he clammed up.
- The rep got real rude with me and said no way Chrysler was going to do anything. I escalated some more with no relief from Chrysler though. Even said lets leave the car at the dealer for a week and do it every day. Chrylser had their report already they felt and said no. The dealership was sympathetic bet that didn't help.
- Went to a lemon law lawyer in NJ. Here is how our law goes - car has to be back for 3 times for the same thing / or be there continous for like 28 days / have less than a certain amount of miles on it / I am the original owner / and the problem has to seriously effect the driveablility or safety of the car. Lemon law is all or nothing. Also if you file lemon law the dealership gets another chance to fix. Lawyer told me my car was not lemon law but we could take Chrysler to arbitration (also implicate the dealer) and get like $6K of which I get $4K. Concept is I still have the car but get money to use on a trade in. Problem is I would now have pissed evryone off including the dealer.
- Did not need the money and chose to keep the car and work with the dealer. Three software upgrades later the car is muched improved (I'd say 90-99% better), the dealer calls me every time a new TSB comes in, works with me very well, and I like the car.

My story is a little different than yours but in my case it appears patience cause of an intermittent problem has paid off. Make sure they give you a car that does not have the same problem or other problems.

If the car gets turned back into the dealer, I feel sorry for the next owner.

The damned problem needs to be fixed.
