The trunk should NOT be able to be released using the key or the button while the car is in gear. This is potentially a very dangerous situation, please let us know what develops!

Might not have been closed all the way and the bump jarred it open... The buttons on the keys don't even work when they are in the ignition and the trunk release button down on the knee bolster won't even work until the car is in park...
Hopefully it was just not closed 100%
That's as I said, however the problem with the "already open" theory is that the alarm would have sounded at start and the 'trunk open' icon would have appeared on the EVIC, but he had reportedly been driving for 20 mins... he even heard the 'click' when it did open.
I definitely want to know how this could have happened.

How is the trunk opening a dangerous situation? If you are moving, the air flow will keep it closed, won't it? If you aren't moving, go shut it.

I do see it as a major problem but I can't see the potentially dangerous situation. Maybe I'm just not thinking it through enough.
If you are not moving fast a crosswind could easily lift the trunk, not only completely obstructing your view, but turning loose objects from the trunk into projectiles to those driving behind you.

I live in a very high wind area. My hubby once had his truck tonneau cover raised to retrieve something from the bed and the wind lifted and sailed it over the top of the truck. It landed on the front of the truck and left a large crease across the hood and above the windshield. That cover required 2 of us to remove it but the wind made it look like a feather flying... thank God no one was in it's path!
